Read it before you sign up. We&apos;ve made it as plain as the law lets us.<\/p>\n\t<\/div>\n<\/section>\n\n<section class=\"sx-sec-v63\">\n\t<div class=\"sx-wrp-9f3 sx-legal-f17 sx-body-t17\">\n\t\t<p><strong>Effective date:<\/strong> 23 October 2026<\/p>\n\t\t<p>These Terms of Use (&quot;Terms&quot;) form a binding agreement between you (&quot;you&quot;) and SilvaBit AI (&quot;SilvaBit&quot;, &quot;we&quot;). By accessing silvabitai.com or opening a SilvaBit AI account, you agree to these Terms. If you do not agree, do not use the Site.<\/p>\n\n\t\t<h2>1. Eligibility.<\/h2>\n\t\t<p>You may use SilvaBit AI only if you are at least 18 years old and legally allowed to form a binding contract in your country of residence. SilvaBit AI is currently available to users in the European Union and Canada. We do not offer the service to users in the United States.<\/p>\n\n\t\t<h2>2. What SilvaBit AI is \u2014 and isn&apos;t.<\/h2>\n\t\t<p>SilvaBit AI is a technology workspace that automates trade placement through regulated partner brokers and provides AI-generated rationale, dashboards and risk framework tools. SilvaBit AI is <strong>not<\/strong>:<\/p>\n\t\t<ul>\n\t\t\t<li>a licensed broker, dealer, bank, or exchange;<\/li>\n\t\t\t<li>an investment advisor, portfolio manager, or financial planner;<\/li>\n\t\t\t<li>a guarantor of returns of any kind.<\/li>\n\t\t<\/ul>\n\t\t<p>All actual trading, execution, custody, and payment flows are performed by regulated partner brokers under their own agreements and oversight.<\/p>\n\n\t\t<h2>3. Account registration.<\/h2>\n\t\t<p>You agree to provide accurate, current, and complete information when registering, and to keep that information updated. You are responsible for safeguarding your password and for any activity under your account. If you suspect unauthorised access, contact us immediately at <a href=\"mailto:support@silvabitai.com\">support@silvabitai.com<\/a>.<\/p>\n\n\t\t<h2>4. Risk acknowledgement.<\/h2>\n\t\t<p>You acknowledge that trading financial instruments carries significant risk, including the risk of losing some or all of your deposited capital. You acknowledge that:<\/p>\n\t\t<ul>\n\t\t\t<li>past performance of any strategy, agent, or trader is not a reliable indicator of future performance;<\/li>\n\t\t\t<li>AI-driven analysis can be incorrect and does not eliminate market risk;<\/li>\n\t\t\t<li>loss thresholds (&quot;bands&quot;) are operating rules, not maximum-loss guarantees;<\/li>\n\t\t\t<li>fast or illiquid markets, slippage, and gap events can produce losses exceeding stated bands;<\/li>\n\t\t\t<li>you are solely responsible for the decision to deposit, trade, and withdraw.<\/li>\n\t\t<\/ul>\n\n\t\t<h2>5. Fees.<\/h2>\n\t\t<p>SilvaBit AI charges a flat 8% fee on each profit withdrawal, shared between SilvaBit and your partner broker. There are no subscription, activation, deposit, or inactivity fees charged by SilvaBit AI. Fees charged by third parties (banks, payment processors) are separate and may apply. Our full fee position is described in <a href=\"\/fr\/articles\/8-percent-fee-breakdown\/\">our fee breakdown article<\/a>.<\/p>\n\n\t\t<h2>6. Acceptable use.<\/h2>\n\t\t<p>You agree not to:<\/p>\n\t\t<ul>\n\t\t\t<li>use the Site or the workspace in violation of any applicable law or regulation;<\/li>\n\t\t\t<li>attempt to interfere with, degrade, or compromise the Site or workspace;<\/li>\n\t\t\t<li>access the Site or workspace through automated scraping, scanning, or reverse-engineering, except through properly authorised APIs;<\/li>\n\t\t\t<li>impersonate any person or misrepresent your affiliation with any person or entity;<\/li>\n\t\t\t<li>use the Site or workspace to launder funds, evade sanctions, or facilitate illegal activity;<\/li>\n\t\t\t<li>reproduce, distribute, or create derivative works of the Site content without written permission.<\/li>\n\t\t<\/ul>\n\n\t\t<h2>7. Intellectual property.<\/h2>\n\t\t<p>The Site, its content, design, source code, trademarks, brand identity, and all associated materials are owned by or licensed to SilvaBit AI. You are granted a limited, non-exclusive, revocable licence to access and use the Site for personal, non-commercial purposes. Any other use requires prior written consent.<\/p>\n\n\t\t<h2>8. Third-party services.<\/h2>\n\t\t<p>Partner brokers, payment processors, and other third-party services operate under their own terms. We are not responsible for their acts, omissions, outages, or policies. Your relationship with a partner broker is governed by that broker&apos;s own agreement with you.<\/p>\n\n\t\t<h2>9. Limitation of liability.<\/h2>\n\t\t<p>To the maximum extent permitted by law, SilvaBit AI and its officers, employees, agents, and licensors are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profit, revenue, data, opportunity, or goodwill, arising out of or related to your use of the Site or workspace.<\/p>\n\t\t<p>Our aggregate liability to you for any claim arising out of these Terms is limited to the greater of (a) the total fees you paid to SilvaBit AI in the twelve months preceding the claim, or (b) \u20ac100.<\/p>\n\t\t<p>Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law \u2014 including liability for fraud, gross negligence, or death or personal injury caused by negligence.<\/p>\n\n\t\t<h2>10. Indemnity.<\/h2>\n\t\t<p>You agree to indemnify and hold harmless SilvaBit AI from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any applicable law, or your infringement of any third-party right.<\/p>\n\n\t\t<h2>11. Suspension and termination.<\/h2>\n\t\t<p>We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, if continued provision of service would expose us to legal risk, or if the service is discontinued in your region. We will give you reasonable notice where feasible. On termination, your right to use the Site and workspace ends immediately. Clauses that by their nature survive termination (including Risk Acknowledgement, Fees already due, Intellectual Property, Limitation of Liability, and Indemnity) continue in force.<\/p>\n\n\t\t<h2>12. Changes to these Terms.<\/h2>\n\t\t<p>We may update these Terms from time to time. For material changes, we will post the updated version on this page and notify registered account holders by email at least 14 days before the change takes effect. Continued use after that date constitutes acceptance of the updated Terms.<\/p>\n\n\t\t<h2>13. Governing law and jurisdiction.<\/h2>\n\t\t<p>These Terms are governed by the laws of Ireland. The courts of Dublin, Ireland have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence that give you the right to bring proceedings in your local courts.<\/p>\n\n\t\t<h2>14. Severability and entire agreement.<\/h2>\n\t\t<p>If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and any other legal pages referenced here, constitute the entire agreement between you and SilvaBit AI.<\/p>\n\n\t\t<h2>15.
